These terms are a contract between you and Kevin Moore, a sole trader trading as Kanda Apps, based in Ireland ("we", "us", "our"). They cover your use of Imaji, our photo and video editing app.
By downloading or using Imaji you accept these terms. If you do not accept them, please do not use the app.
They are written to be read. Where a sentence grants us something or limits what you can claim, we have tried to say so plainly rather than bury it.
01The agreement
These terms, together with our Privacy Policy, are the whole agreement between us about Imaji.
The app store is not a party to it. You download Imaji through Apple's App Store or Google Play. Those companies handle distribution and payment, and their own terms apply to that relationship, but this agreement is between you and us. Apple and Google are not responsible for Imaji, for supporting it, or for any claim you might have about it — though Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If any part of these terms turns out to be unenforceable, the rest still stands.
02Who can use Imaji
You must be at least 16 years old to use Imaji, or older if your country sets a higher age for agreeing to contracts like this one. If you are using Imaji on behalf of a business, you confirm you are authorised to accept these terms for it.
You may not use Imaji if you are barred from doing so under the laws of your country, or under sanctions or export controls that apply to you.
03Your content stays yours
You keep every right you already have in the photos and videos you import and in the results you create. We claim no ownership of them.
We do not use your photos to train AI models — not ours, not anyone else's — and our agreement with our AI provider does not permit them to either.
We need one narrow permission to do the job you asked for. When you use an AI feature, you grant us a licence to transmit, store temporarily, and process that specific image, solely to produce the result you requested and return it to you. That licence covers nothing else, and it ends when the operation finishes.
You confirm that you own the images you import or otherwise have permission to edit them, and that editing them does not infringe anyone's copyright, trade mark, privacy or publicity rights. If a photo contains another person, you are responsible for having their agreement before you transform it — generative features can place a recognisable person into a scene that never happened.
04AI features and what they do
Five features send an image off your device for processing: Remove Background, Magic Eraser, Upscale, AI Styles and AI Video. Everything else — cropping, filters, exposure, colour — happens on your device and nothing is uploaded. Our Privacy Policy sets out exactly what is sent, to whom, and what happens to it.
AI Styles and AI Video are generative. They produce new imagery based on your photo. You should understand what that means before you rely on a result:
- A result can change nearly everything except the subject's face — clothing, pose, background, lighting, era, and the medium the image appears to be made from. Costume and transformation presets do this on purpose.
- AI Video generates motion that did not happen. The subject may appear to move or gesture in ways they never did.
- Results are synthetic. They are not records of real events and must not be presented as though they were.
Generative models are not deterministic. The same photo and the same preset can produce different results, and some results will simply be poor. We cannot guarantee that any particular attempt will succeed, look a particular way, or match an example tile shown in the app — examples illustrate a preset's intent, not a promised outcome.
05Your results
You own your results, to the extent they can be owned, and you may use them personally or commercially. Two honest caveats:
- AI output may not be copyrightable. In many countries, including Ireland, the UK and the United States, purely machine-generated material may attract limited copyright protection or none at all. We cannot promise you an enforceable right in a result.
- Results are not unique. Another user giving a similar instruction may receive a similar result. We grant you no exclusivity.
06Acceptable use
You agree not to use Imaji to create, upload or share anything that:
- is sexual content involving a minor, or sexualises anyone who is or appears to be a minor — under any circumstances, in any form;
- is sexual or intimate imagery of a real person created without their consent;
- depicts a real, identifiable person saying or doing something they did not, in a way intended or likely to deceive;
- harasses, bullies, threatens, defames or demeans anyone, including on the basis of race, ethnicity, religion, disability, sex, gender identity or sexual orientation;
- promotes violence, self-harm, terrorism or an illegal act;
- infringes someone else's copyright, trade mark, privacy or publicity rights;
- is used for fraud, impersonation, or to create false identity documents or records;
- is unlawful where you are.
You also agree not to reverse engineer, decompile or tamper with the app; not to circumvent credit limits, moderation checks or entitlement checks; not to access our services other than through the app; not to resell access or operate Imaji as a service for others; and not to use automated means to submit work at a volume the app is not designed for.
07Moderation and enforcement
Every image submitted to an AI feature is automatically screened before it is processed. If it is flagged, the request is refused and no generation takes place. The check is automated, no person sees your photo as part of it, and a refusal costs you no credits. It will sometimes be wrong — if an ordinary photo is refused, tell us.
You can report a result you consider inappropriate from the screen where it appears, or by emailing us. We review reports and act on them.
If you breach §06 we may suspend or terminate your access, with or without notice depending on the seriousness. For a serious breach we may do so immediately and without a refund, and where the law requires it we will report the matter to the authorities.
08Subscriptions
Imaji offers paid plans (currently Pro and Studio). The plan names, exact prices, billing periods and any trial are shown on the subscription screen in the app and on the App Store listing before you confirm a purchase. Prices vary by country and may change.
- Payment is taken by Apple or Google, not by us. We never see your card details.
- Subscriptions renew automatically at the end of each period, at the then-current price for your plan, until you cancel.
- Your account is charged for renewal within 24 hours before the current period ends, unless you cancel at least 24 hours before that point.
- Any free trial period is forfeited when you buy a subscription, and converts to a paid subscription unless cancelled at least 24 hours before it ends.
- You manage and cancel a subscription in your Apple ID or Google Play account settings, not in the app. We cannot cancel it for you.
- If we increase the price of your plan you will be told in advance and asked to agree before it applies; if you do not agree, your subscription ends at the end of the current period.
09Credits and allowances
AI operations are metered in credits. Each plan includes a monthly credit allowance, and each operation costs a number of credits reflecting what it costs us to run:

The current cost of each operation is shown next to it in the app, and is always what applies. Some plans also carry a daily cap alongside the monthly allowance, to keep the service available for everyone; where one applies it is shown in the app.
Terms that matter:
- Credits are an allowance under your subscription, not a purchased currency. They have no cash value, cannot be bought separately, exchanged, transferred, or redeemed for money.
- Allowances reset each billing period and do not roll over. Unused credits are lost at the end of the period.
- Credits are reserved when an operation starts and charged when it succeeds. If an operation fails, the credits are returned to you.
- A request refused by the safety check costs nothing.
- We may adjust credit costs if our providers' prices change. We will give you notice in the app before an increase takes effect, and it will not apply to a billing period you have already paid for.
- Unused credits are not refundable when a subscription ends or is terminated.
10The free plan
Imaji can be used without paying. All on-device editing is free and unlimited. The free plan includes a small monthly credit allowance so you can try the AI features before deciding whether to subscribe. It is a taster, not a tier — we may change or withdraw it at any time, and it comes with no guarantee of availability.
11Cancelling
You can cancel at any time in your Apple ID or Google Play account settings. Cancelling stops the next renewal; you keep your plan and its allowance until the end of the period you have already paid for. We do not cut access off the moment you cancel.
After it ends, your account reverts to the free plan. Your photos, projects and past results stay on your device — they are not deleted because a subscription lapsed.
12Refunds and your right to cancel
Refunds are handled by the store you bought from, not by us. We cannot issue, approve or reverse a refund for an App Store or Google Play purchase. Request one through reportaproblem.apple.com or Google Play's refund process.
If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a contract for digital content. Because Imaji's AI features are supplied immediately, you are asked to consent to that immediate supply when you subscribe, and in doing so you acknowledge that you lose the 14-day right of withdrawal once supply begins. This does not affect your separate statutory rights if the app is faulty, not as described, or not of satisfactory quality — those rights always survive, and nothing in these terms limits them.
If something is genuinely wrong, email us before going to the store. We would rather fix it.
13Availability and changes to the app
We aim to keep Imaji working and available, but we do not promise it will be uninterrupted or error-free. AI features depend on third-party providers and may be slow, degraded or unavailable at times outside our control.
We may add, change or remove features, including presets and AI models, as the app develops. If we remove something material from a paid plan, you may cancel and — where the law entitles you to it — receive a proportionate refund for the unused part of your period through the store.
Imaji requires a supported device and operating system version, and an internet connection for the AI features. We may end support for older OS versions.
14Disclaimers
Except for the rights the law gives you that cannot be excluded, Imaji is provided "as is". We do not warrant that it will meet your requirements, that results will be accurate, suitable for a particular purpose, or free from defects, or that any specific generation will succeed.
AI results can be wrong, strange, or unsuitable. Do not rely on a generated image or video as a record of anything real, and check anything that matters before you use it.
Your photos live on your device, and keeping backups is your responsibility. Deleting the app deletes its data.
15Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be limited — including your statutory rights as a consumer.
Subject to that: we are not liable for loss that was not reasonably foreseeable, for loss of profit, business, goodwill or opportunity, or for loss or corruption of data where you have not kept a reasonable backup.
Also subject to that, and to the maximum extent the law allows, our total liability to you arising out of or in connection with Imaji is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) €50.
If you are a consumer, Imaji is for personal use; we are not liable for business losses if you use it commercially.
You are responsible for the content you create, and you agree to indemnify us against third-party claims arising from your breach of §06 or from your use of images you did not have the right to edit. This does not apply to consumers to any greater extent than the law permits.
16Ending this agreement
You can end it at any time by cancelling any subscription and deleting the app. You can delete your account from within the app, which removes your account data as described in the Privacy Policy.
We may suspend or end your access if you breach these terms, if we are required to by law, or if we discontinue Imaji. Except where you have seriously breached §06, if we end your access for our own reasons while you have paid for a period, we will help you obtain a proportionate refund through the store.
Sections that by their nature should survive — content ownership, disclaimers, liability, and governing law — continue to apply after this agreement ends.
17Changes to these terms
We update these terms as the app changes. The date at the top always reflects the current version. If a change materially affects your rights or what you pay, we will tell you in the app before it takes effect, and you may cancel if you do not accept it. Continuing to use Imaji after that point means you accept the updated terms.
18Governing law and disputes
These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in your local courts.
Please contact us first — most disputes are resolved by an email. If we cannot settle it between us, consumers in Ireland can contact the Competition and Consumer Protection Commission, and consumers elsewhere in the EU can contact the European Consumer Centre Ireland, which handles cross-border complaints against Irish traders free of charge. (The European Commission's online dispute resolution platform closed in July 2025 and is no longer a route.)
